Advisors shall not be liable if any transaction does not fructify or may not be completed or for any failure on part of the Advisors to perform any of its obligations under these terms and conditions or those applicable specifically to its services/facilities if performance is prevented, hindered or delayed by a Force Majeure event (defined below) and in such case its obligations shall be suspended for so long as the Force Majeure event continues.
“Force Majeure Event” means any event due to any cause beyond the reasonable control of the Advisors, including without limitations, unavailability of any communication systems, breach, or virus in the processes, sabotage, fire, flood, explosion, acts of god, civil commotion, strikes or industrial action of any kind, riots, insurrection, war, acts of government, computer hacking, unauthorized access to computer data and storage devices, computer crashes, malfunctioning in the computer terminal or the systems getting affected by any malicious, destructive or corrupting code or program, mechanical or technical errors/failures or power shut down, faults or failures in telecommunication etc.
I understand and accept Advisors has the absolute discretion to amend or supplement any of the Website Usage Terms at any time and will modify the date in the terms. Changed Terms and Conditions shall be communicated to me on the Advisors website. By using the services, I shall be deemed to have accepted the changed Website Usage Terms.
• Restricted Countries

Suspension, Deactivation, Termination. Your continued access to Ton Fx depends upon fulfillment of necessary Identity verification requirements as per IDENTITY VERIFICATION Policy from time to time. If you provide any information that is untrue, inaccurate, not current or incomplete (or becomes untrue, inaccurate, ambiguous, not current or incomplete), or if we have reasonable grounds to suspect that such information is untrue, inaccurate, ambiguous, not current or incomplete, we have the right to suspend, deactivate, restrict or terminate your Account and refuse any and all current or future use of Ton Forex Limited (or any portion thereof) at our sole discretion, in addition to any right that we have against you at law or in equity, for any misrepresentation of information provided by you. We have the right to disable your access to the User Account or any part of it, whether chosen by you or allocated by us, at any time, if in our reasonable opinion you have failed to comply with any of the provisions of these Terms, including without limitation the IDENTITY VERFICATION Policy.
When we say “Services“, we refer about all of our services as described above, which includes the Trading Services, the Copy Trading Services, the custody services and other related services.
Some of the terms in the Agreement only apply to certain Services. If you do not use those Services, then those terms will not be a part of your Agreement with us. We will always be clear which terms apply to which Service, but please contact us if anything is unclear.
If we consider that the complex product is inappropriate for you, or if you do not provide us with the required information to conduct the Appropriateness Assessment, we may not allow you to trade in such instruments or we will provide you with a warning in relating to the trading of such instruments.
• Accessing Your Account
All activities under your Account shall be deemed as activities carried out or authorized by the registered User. You shall only use Account to transact on your own account and not on behalf of any other person or entity. We disclaim any liability arising from any transactions/instructions/sale/purchase which are not conducted by you or for any obligations of other users to You, any acts or omissions of a third party or user of Ton Forex with whom you choose to deal with. If you know or suspect that anyone other than you know or has unauthorized access to your Account Information or any part of it, you must promptly notify us by sending us an E-mail at [email protected]. We are not liable for any losses/damages/costs or other consequences of unauthorized use of your account.
